hereinafter referred to as the “Organizer”.

4. assembly, dismantling
Details on set-up and dismantling are regulated in the exhibitor information (EXPO-Letter), which is sent to all exhibitors in the run-up to the TESTIVAL.
5. deadlines
Registration deadline is 30.09.2024.
6. trade fair admission
The organizer decides on admission to the trade fair at its own discretion, taking into account the event philosophy. The exhibitor contract comes into effect when a corresponding confirmation is sent. Admission is only valid for the respective registered event and for the exhibits and services registered therein.
7. stand allocation
The organizer will make every effort to accommodate stand placement requests. There is no entitlement to the allocation of a specific stand space. In individual cases, the organizer is entitled to allocate the exhibitor a different stand area from that originally allocated. If such a change results in a reduction in stand space, the organizer shall refund the difference to the exhibitor.
8. provision of stand space, co-exhibitors
Without the prior written consent of the organizer, the exhibitor may not exchange or share his stand, nor transfer it in whole or in part to third parties. Surcharges for co-exhibitors must be agreed with the organizer. If a stand area is used by another company without prior consent, the organizer is entitled to have the stand area vacated at the exhibitor’s expense. The exhibitor is liable for any damage caused by co-exhibitors on the stand space allocated to him.
9. terms of payment
9.1. The prices quoted for the exhibition space and other costs are valid for one booked event. Subsequent price increases are only permitted with the exhibitor’s consent. With the confirmation of admission, the exhibitor will receive an invoice from the organizer for the stand rental and any additional costs.
9.2. Receipt of payment by the organizer is a mandatory prerequisite for the exhibitor to obtain and use the stand space.
9.3. Complaints about invoices must be made in writing within 2 weeks of receipt. The invoice amount is due without deductions within 14 days of the invoice date, but no later than 30.09.2024. Invoices issued after 30.09.2024 are due immediately.
10. realization of the event
The organizer reserves the right to cancel the event up to four weeks before the scheduled date without giving reasons. In this case, the organizer will refund any participation fees already paid. Any further compensation for damages is excluded. The organizer also reserves the right to postpone the event for important reasons.
11. trade fair operation, design
11.1. All stand structures must comply with both the statutory regulations and the event conditions of Hockenheimring GmbH.
11.2. The stand areas must be occupied by both goods and exhibitor personnel during the entire opening hours.
11.3. Dismantling work may not begin before the official end of the event.
11.4. The playing of film and sound recordings on the stand is only permitted with the prior written consent of the organizer. The exhibitor is responsible for registering with the Society for Musical Performing and Mechanical Reproduction Rights (GEMA).
11.5. Stand allocation is based on the information provided by the exhibitor with the application. Deviations for planning reasons must be expected. If the content of the stand confirmation differs from the content of the exhibitor’s application, the contract shall be concluded in accordance with the stand confirmation, unless the exhibitor objects in writing within two weeks.
11.6. Different test tracks for the respective vehicle categories will be offered at the trade fair. Use is regulated in separate terms of use.
11.7. The participation fee includes the provision of the exhibition space, a certain number of exhibitor passes, exhibitor support by the project management, the provision of the trade fair’s own information systems, target group-specific marketing of the event and cleaning of the halls. The prices refer to the entire duration of the trade fair. Further details are regulated by the respective exhibitor packages booked.
11.8. If the stand is canceled, the full participation fee is due if the stand cannot be rented to another exhibitor. If the organizer is able to sublet the stand, a cancellation fee of 25% of the participation fee will be charged. The participation price is the excellent regular price for the respective exhibition space. Cancellation fees are calculated on the basis of the regular prices of the respective package booked and not on the basis of discounts granted. If no standard package has been booked, the cancellation fees will be calculated on the basis of the prices of the respective basic package.
12. liability
12.1. The organizer accepts no liability for goods brought into the halls by the exhibitor or the owners of the stand personnel.
12.2. The organizer shall be liable within the scope of the statutory regulations exclusively in the event of intent and gross negligence. The exhibitor shall be liable for any damage caused by the exhibitor’s personnel or third parties commissioned by the exhibitor in accordance with the statutory provisions.
13. final provisions
13.1. The law of the Federal Republic of Germany shall apply.
13.2. The place of jurisdiction for all disputes arising from this contract shall be Hockenheim. All amendments and additions must be made in writing. There are no verbal collateral agreements.
13.3. Should individual provisions of the contract be wholly or partially invalid, this shall not affect the validity of the remaining provisions and agreements. The wholly or partially invalid provision shall be replaced by a valid provision which comes closest to achieving the economic purpose originally pursued by the contracting parties.
